TERMS OF USE

Last Updated: September 15, 2026

These Terms of Use (the “Terms”) are a binding agreement between you and INTV POST LLC, a Wyoming limited liability company (“INTV POST,” “we,” “us,” or “our”). These Terms govern your access to and use of filmreadiness.com (the “Site”), the Film Readiness assessment (including the free Film Readiness Self-Audit and the paid Full Film Readiness Analysis), any resulting report, and related content, features, and services (collectively, the “Services”).

Please read these Terms carefully. By checking the box indicating your agreement to these Terms, purchasing or submitting an assessment, creating an account, or otherwise accessing or using the Services, you agree to be bound by these Terms and acknowledge our Privacy Policy. If you do not agree, do not access or use the Services.

If you use the Services on behalf of a company, production, or other entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” includes both you and that entity.

1. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for activity conducted through your account and must promptly notify us at info@filmreadiness.com if you suspect unauthorized access or use.

Accounts, access credentials, assessments, and reports may not be shared, transferred, sold, or made available to another person except to members of your own project team solely for the internal evaluation of the project for which the assessment was purchased or completed. You remain responsible for their compliance with these Terms.

2. The Film Readiness Assessment

Film Readiness includes (a) the free Film Readiness Self-Audit, which provides an initial readiness snapshot, and (b) the Full Film Readiness Analysis, a paid $249 assessment that includes a downloadable report. Both are informational planning and self-assessment tools based on information you submit and criteria used by Film Readiness at the time of the assessment, and these Terms apply to both. The Services may include assessment questions, scoring, recommendations, coaching or educational content, reports, and other project-readiness information.

Assessment results depend on the accuracy and completeness of the information you provide. You are solely responsible for reviewing the results, independently evaluating any recommendations, obtaining professional advice when appropriate, and making all decisions concerning your project.

The Services are not affiliated with, sponsored by, endorsed by, or approved by any distributor, sales agent, streaming service, platform, festival, broadcaster, financier, or other third party unless we expressly state otherwise in writing.

3. No Professional Advice or Guarantee

The Services and all assessment results and reports are provided for general informational, educational, and business-planning purposes only. They are an assessment—not legal advice or distribution advice—and do not constitute legal, tax, investment, financial, accounting, insurance, production, technical, sales-agent, distribution, or other professional advice or opinion. Your use of the Services does not create an attorney-client, fiduciary, advisory, partnership, joint-venture, or agency relationship with INTV POST.

Standards, market conditions, project requirements, and third-party preferences and decisions may change and are outside INTV POST’s control. INTV POST does not guarantee acceptance by any platform or any other third party and does not represent or guarantee:

  1. the accuracy or completeness of any assessment, score, recommendation, or report;
  2. that the Services will identify every issue affecting your project;
  3. that your project is ready or eligible for any particular opportunity;
  4. that your project will be selected, accepted, approved, acquired, financed, licensed, sold, exhibited, or distributed;
  5. that you will obtain any particular score, result, revenue, financing, distribution arrangement, or commercial outcome; or
  6. that any third party will apply the same standards, reach the same conclusions, or make any particular decision.

You should consult qualified legal counsel and other appropriate professionals regarding your project and circumstances.

4. Fees, Payment, and Refunds

The free Film Readiness Self-Audit requires no payment. The fee for the Full Film Readiness Analysis is $249, plus any applicable taxes disclosed at checkout. You authorize INTV POST and its payment processor to charge the payment method you provide for all amounts shown at checkout.

Because Film Readiness is a digital assessment made available immediately after purchase and/or generated from information you submit, all sales are final and fees are nonrefundable after access is provided, the assessment is submitted, or processing begins, except where required by applicable law or where INTV POST elects otherwise in writing.

This no-refund policy does not permit INTV POST to retain payment for an assessment that INTV POST fails to deliver or for a duplicate charge or other verified payment-processing error. To report a non-delivery or payment error, contact info@filmreadiness.com.

5. Limited License

Subject to your payment of all applicable fees and continued compliance with these Terms, INTV POST grants you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to access and use the Services and the report generated for you solely for your internal evaluation of the film project for which you purchased or completed the assessment.

You may download or print one or more copies of your report for your own records and may share it confidentially with your attorneys, professional advisers, financiers, distributors, or members of your project team for purposes relating to that project. No other right or license is granted, whether by implication, estoppel, or otherwise.

6. Ownership and Intellectual Property

As between you and INTV POST, INTV POST owns all right, title, and interest in and to the Site and Services, including the Film Readiness assessment; questions; selection, arrangement, and presentation of content; scoring framework; materiality weightings; route-applicability and conditional logic; category benchmarks and thresholds; methodologies; recommendations; coaching and educational content; reports and templates, excluding your Project Materials as defined below; software; source and object code; databases; designs; graphics; interfaces; documentation; trademarks; service marks; logos; trade names; domain names; and all modifications, additions, updates, revisions, adaptations, derivative works, enhancements, improvements, and future developments of the foregoing (collectively, the “INTV POST Materials”).

The INTV POST Materials are protected by applicable copyright, trademark, trade-secret, contract, and other intellectual-property and proprietary-rights laws. Except for the limited license expressly granted in Section 5, these Terms do not transfer to you any ownership or other rights in the INTV POST Materials. INTV POST and its licensors reserve all rights not expressly granted.

The FILM READINESS name, related logos, and other source identifiers are trademarks or service marks of INTV POST. You may not use them without INTV POST’s prior written permission.

7. Confidentiality and Trade-Secret Protection

The nonpublic features of the Services—including scoring weights, benchmarking thresholds, blocker logic, route-applicability logic, internal methodologies, source code, and nonpublic technical and business information—are confidential and may constitute trade secrets of INTV POST.

You may use such information only as expressly permitted by these Terms. You may not disclose, publish, disseminate, copy, extract, reverse engineer, or use it for any unauthorized purpose. Unauthorized access, copying, scraping, disclosure, reverse engineering, use, or misappropriation may violate these Terms and INTV POST’s intellectual-property and proprietary rights and may result in civil claims and remedies.

8. Prohibited Conduct

You may not, directly or through another person:

  1. copy, reproduce, republish, upload, post, transmit, distribute, sell, resell, license, sublicense, rent, or commercially exploit any portion of the Services or INTV POST Materials, except as expressly permitted by these Terms;
  2. modify, translate, adapt, create derivative works from, decompile, disassemble, reverse engineer, decode, or attempt to discover the source code, scoring methodology, weights, thresholds, logic, or underlying structure of the Services;
  3. use scraping, crawling, bots, spiders, scripts, automated queries, data-mining tools, artificial-intelligence systems, or other automated means to access, monitor, extract, copy, test, or collect any part of the Services;
  4. use the Services, assessment questions, scoring system, reports, recommendations, coaching content, or other INTV POST Materials to develop, train, evaluate, benchmark, market, or operate a competing or substantially similar product or service;
  5. disclose or publish assessment questions, scoring details, benchmark information, nonpublic methodologies, or other confidential aspects of the Services;
  6. share credentials, bypass usage limits, circumvent security or technical protections, probe or test vulnerabilities, or interfere with the operation, integrity, or security of the Services;
  7. remove, obscure, or alter any copyright, trademark, confidentiality, attribution, or proprietary-rights notice;
  8. impersonate another person, misrepresent your identity or authority, or submit information for a project you are not authorized to assess;
  9. upload or transmit malicious code or content that is unlawful, infringing, defamatory, fraudulent, or harmful; or
  10. use the Services in violation of applicable law or another person’s rights.

9. Your Project Materials

“Project Materials” means the information and materials you submit through the Services, including project details, assessment answers, notes, and support communications. As between you and INTV POST, you retain your ownership rights in your Project Materials.

You grant INTV POST and its service providers a nonexclusive, worldwide, royalty-free license to host, reproduce, process, transmit, display, and otherwise use your Project Materials only as reasonably necessary to provide, generate, administer, secure, troubleshoot, and support the Services; comply with law; and enforce these Terms.

You represent and warrant that you own or have all rights and permissions necessary to submit the Project Materials and authorize their use as described in these Terms and the Privacy Policy. Do not submit information that you are prohibited from disclosing or that is subject to another person’s confidentiality, privacy, publicity, or intellectual-property rights unless you have authorization to do so.

You are responsible for retaining your own copies of your Project Materials and report. Film Readiness is not a records-storage or archival service.

10. Privacy and Communications

Our Privacy Policy, available through the Site and presented at checkout, explains how we collect, use, retain, and disclose information in connection with the Services. The Privacy Policy is incorporated into and forms part of these Terms. If these Terms conflict with the Privacy Policy concerning the handling of personal information, the Privacy Policy controls.

You agree that we may send you transactional and service-related communications, including payment confirmations, assessment and report delivery notices, security notices, support responses, and changes affecting the Services or these Terms.

We will send promotional emails only as permitted by applicable law and any marketing preferences you provide. Marketing consent is not a condition of purchase. You may unsubscribe from promotional emails using the unsubscribe mechanism included in those messages, but you may continue to receive nonpromotional communications relating to your transactions or use of the Services.

11. Third-Party Services and Links

The Services may rely on or link to third-party websites, platforms, payment processors, hosting providers, or other services. INTV POST does not control and is not responsible for third-party services, content, availability, security, privacy practices, or terms. Your use of third-party services may be governed by separate terms and policies between you and the applicable provider.

References to third parties or their standards do not constitute an endorsement, affiliation, sponsorship, or guarantee.

12. Suspension and Termination

INTV POST may suspend or terminate your access to the Services if you breach these Terms, fail to pay applicable fees, create a security or legal risk, interfere with the Services, or use the Services in a manner that may harm INTV POST or another person.

Upon termination, your right to access and use the Services ends immediately. Sections 3, 4, 6 through 9, and 12 through 20 survive termination, together with any other provision that by its nature should survive.

13. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, SERVICES, ASSESSMENTS, SCORES, RECOMMENDATIONS, REPORTS, AND INTV POST MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. INTV POST DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

INTV POST DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, AVAILABLE, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE SERVICES WILL IDENTIFY EVERY ISSUE AFFECTING A PROJECT; OR THAT ANY ASSESSMENT CRITERIA OR RESULT WILL CORRESPOND TO THE REQUIREMENTS OR DECISIONS OF ANY THIRD PARTY.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, this Section applies only to the extent permitted by applicable law.

14. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INTV POST AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOST FINANCING, LOST DISTRIBUTION, LOST REVENUE, BUSINESS INTERRUPTION, LOSS OF GOODWILL, OR LOSS OR CORRUPTION OF DATA, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF INTV POST AND THE OTHER PARTIES IDENTIFIED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO A PARTICULAR ASSESSMENT, THE SERVICES, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO INTV POST FOR THE ASSESSMENT GIVING RISE TO THE CLAIM.

These limitations apply regardless of the form or theory of liability, whether in contract, tort, statute, strict liability, or otherwise, and even if a limited remedy fails of its essential purpose. Nothing in these Terms excludes or limits liability, remedies, or rights that cannot lawfully be excluded, limited, or waived.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM AROSE, OR IT IS PERMANENTLY BARRED.

15. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless INTV POST and its members, managers, officers, employees, agents, contractors, licensors, service providers, successors, and assigns from and against third-party claims, liabilities, damages, judgments, settlements, losses, costs, and reasonable attorneys’ fees arising out of or relating to:

  1. your Project Materials;
  2. your breach of these Terms;
  3. your violation of applicable law or another person’s rights; or
  4. your misuse of the Services or INTV POST Materials.

INTV POST may control the defense and settlement of a claim subject to indemnification. You may not settle any such claim without INTV POST’s prior written consent if the settlement admits wrongdoing by, imposes obligations on, or fails to provide an unconditional release to INTV POST.

16. Changes to the Services or Terms

INTV POST may modify, suspend, or discontinue any part of the Services. If you have paid for an assessment that has not been delivered, any discontinuation will be subject to Section 4 and applicable law.

INTV POST may update these Terms from time to time by posting a revised version and updating the “Last Updated” date. Changes apply prospectively upon posting or on a later date stated in the revised Terms. If a change materially affects a previously purchased but uncompleted assessment, we will provide notice and request renewed assent where required by applicable law. Your continued use after the effective date of revised Terms constitutes acceptance of the revised Terms.

17. Governing Law and Exclusive Forum

These Terms and any dispute arising out of or relating to these Terms or the Services are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules.

Except where applicable law requires otherwise, the state and federal courts located in the State of Wyoming will have exclusive jurisdiction and venue over any dispute arising out of or relating to these Terms or the Services, and each party consents to the personal jurisdiction of those courts.

Nothing in these Terms deprives you of any nonwaivable protection of the laws of the jurisdiction in which you reside or waives any venue, jurisdiction, substantive right, or remedy that cannot lawfully be waived.

18. Notices

You may send notices or questions concerning these Terms to:

INTV POST LLC
Email: info@filmreadiness.com
Mailing Address: 30 N Gould St, Ste R
Sheridan, WY 82801

INTV POST may send notices to the email address associated with your purchase or account, through the Services, or by other legally permitted means.

19. General Terms

These Terms and the incorporated Privacy Policy constitute the entire agreement between you and INTV POST concerning the Services and supersede prior or contemporaneous communications on that subject.

If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect. INTV POST’s failure to enforce a provision is not a waiver. A waiver must be in writing and signed by an authorized representative of INTV POST.

You may not assign or transfer these Terms or any right under them without INTV POST’s prior written consent. INTV POST may assign these Terms in connection with a merger, reorganization, sale of assets, financing, or by operation of law.

These Terms do not create any third-party beneficiary rights. Headings are for convenience only. The words “including” and “includes” mean “including without limitation.”
